What is an Affidavit?
An affidavit is a sworn statement made in writing in which the person giving the written statement promises that the facts stated within it are true, either by taking an oath or a solemn affirmation. An affidavit must be sworn in person before a commissioner of oaths, notary public or lawyer.
How to Write an Affidavit
When writing an affidavit, you must ensure that you follow the proper formatting and style rules. Use these tips and example sentences to get started:
-
Introduction: Affidavits typically begin with a brief background of the author and the reason for crafting the affidavit. This will include your full legal name, occupation and address. You should then include one or two sentences about why you are writing the affidavit.
-
Grammar: You should generally write in the first person using “I” statements and statements from your perspective. For example, I saw the red Honda Accord run the stop sign at Main and First Streets. It hit a green Toyota pick-up truck on the passenger side.
-
Stick to the facts: Affidavits are not about your opinion but about facts that you know. In general, one fact per paragraph is advisable. However, the number of facts to include in your affidavit depends on the situation.
